This Privacy Policy explains what personal data I collect, why and how I use it, who I share it with, the rights that you have over your personal data and how I keep it secure.

I may change this Privacy Policy from time to time so please check this page occasionally to ensure that you’re happy with any changes.

Who I am

I am Jane Murphy, a Belgo-Canadian lawyer registered at the Brussels Bar, with offices at 1030 Brussels, Avenue Huart Hamoir 71.

I am the controller for the personal data that I process, unless stated otherwise.

The type of information that I collect

The personal data that I may collect from you includes your first name, last name, job title, company name, e-mail address, company address, home address, telephone number, country, nationality, date and place of birth, civil status, ID-card, national number, VAT number, bank account details, register of legal entities number, device-specific information and log information (as described below) and other personal information that you may communicate to me or that is otherwise collected from you as described below (“Personal Data”).

How I collect information from you

Information that you provide to us

I collect Personal Data that you provide directly to me. For example, I collect information when you send me a request or an inquiry, become a client, apply for a job, subscribe to my e-newsletter, fill out a form or survey or submit an on-line meeting request, download information or documents that I publish, use my services or otherwise interact or communicate with me in any other way.

Information that I collect from other sources

I may also obtain information from other sources and combine that with the information that I collect as described above. For example, I may collect information about you from my clients (e.g. as my client’s employee, independent contractor, expert, accountant, etc.) or from third parties (including but not limited to social media platforms, data enrichment providers and publicly available sources, but only where I have checked that these third parties either have your consent or are otherwise legally permitted or required to disclose your Personal Data to me).

Information that I automatically collect

I may automatically collect information about you, including:

  • Website usage: I log information, including the type of browser you use, access times, pages viewed, your IP address, your general location and the page you visited before navigating to my website.
  • Device information: I collect information about the computer or mobile device you use to access my website, including the hardware model, operating system and unique device identifiers.
  • Information collected by cookies and other tracking technologies: I and my service providers use various technologies to collect information, including cookies. Cookies are small data files stored on your hard drive or in device memory that help me improve my services and your experience, see which areas and features of my services are popular, and count visits. Why I collect information about you 

As part of the assignment that you entrust to me as your lawyer, I collect a certain amount of information for the following purposes:

  • to handle inquiries and requests
  • to provide you with my legal services
  • to carry out the tasks related to the assignment that you gave me
  • to verify any potential conflict of interest
  • to comply with my legal obligations, including those under the Law of 18 September 2017 on the prevention of the use of the financial system for the purpose of money laundering and terrorist financing (“Anti-Money Laundering Legislation”)
  • to communicate with you
  • to schedule a meeting
  • to provide you with information regarding my services
  • to manage my files
  • to manage job applications
  • to respond to public or private tenders for legal services
  • for invoicing and administrative purposes
  • to keep you informed on the latest legal news that can have an impact on you or your business, including our e-newsletters
  • to provide, operate, optimize and maintain my website, system administration and security
  • to compile aggregated statistics about the usage of the website and better understand the preferences of my clients and contacts
  • to carry out other legitimate business purposes, as well as other lawful purposes about which I will notify contacts, visitors and clients.

Legal basis for processing

The legal basis for processing the Personal Data described above will depend on the Personal Data concerned and on the specific context in which I process it. I primarily rely on four legal bases to process your Personal Data:

  1. I process Personal Data when it is necessary for me to do so in order to provide you with legal services pursuant to the contract that I have entered into with you.
  2. In some cases, I may also have a legal obligation to process your Personal Data, for example under the Anti-Money Laundering Legislation. If I ask you to provide Personal Data to comply with a legal requirement, I will make this clear at the relevant time and inform you on whether the provision of your Personal Data is mandatory or not (as well as of the possible consequences if you do not provide your Personal Data).
  3. In certain cases, I may process your Personal Data where it is necessary in our legitimate interests, where those legitimate interests are not overridden by your rights and freedoms. This may include, for example, the processing of your Personal Data on the basis of my client’s legitimate interests if you are my client’s employee, independent contractor, expert, accountant or other contact person identified by my client. This may also include direct marketing, usage statistics and analytics to better understand how to use the website so that I can improve my services.
  4. Where you have given me valid consent to use your Personal Data in certain ways, I will rely on your consent.

How long I keep your information

I will hold your Personal Data in my systems only for as long as is necessary for the relevant activity. Regarding the provision of legal services, I will hold your Personal Data after the termination of our contract for as long as necessary for tax, accounting and other legal reasons (e.g. under Anti-Money Laundering Legislation) or in order to safeguard my rights and interests or in the event of a dispute. Some Personal Data may also be kept for a longer period so that I can continue to send you updates on new legal developments that may have an impact on you or your business.

Who has access to your information

I will not share your Personal Data with any third parties for the purposes of direct marketing or otherwise sell or rent your Personal Data to third parties.

I may share your Personal Data to third parties in the following circumstances or as otherwise described in this Privacy Policy:

  • With your consent or pursuant to your instructions (e.g. notaries, experts, bailiffs, etc.)
  • To consultants, subcontractors and other service providers who need access to such information to carry out work on my behalf or to assist me in the provision of the website and other business-related functions such as website analytics
  • As part of a duty to disclose or share your Personal Data in order to comply with a legal obligation, for example, by a court order, or for the purposes of prevention of fraud or other crime, or to enforce or apply the Terms and Conditions or to protect the rights, property or safety of my clients.

When I use third party service providers, I only disclose the Personal Data that is necessary to deliver the service and I have a contract in place that requires them to keep your information secure and to keep it for no longer than necessary for the purposes of completing the tasks and providing the services to you on my behalf.

Your rights in relation to your Personal Data

You have the following rights:

  • Right to withdraw your consent

If I have asked for your consent to process your Personal Data, you may withdraw that consent at any time.

  • Right of access

You can ask me what information I hold about you, and you can ask for copies of your Personal Data.

  • Right to Rectification

You can ask me to correct your Personal Data it if it is inaccurate or to complete it if it is incomplete.

  • Right of erasure

You have the right to ask me to delete your Personal Data in certain circumstances (for example, if I no longer need your Personal Data, if you initially consented to the use of your Personal Data but have now withdrawn your consent, if you have objected to the use of your Personal Data and your interests outweigh my interests)

  • Right to restrict the processing

In certain circumstances, you have the right to ask me to stop using your Personal Data for a period of time (for example, if you believe I am not doing so lawfully).

  • Right to object to the processing

You have a right to object to the processing of your Personal Data where I rely on my legitimate interests to process your Personal Data.

  • Right to data portability

You have the right to ask that I transfer the Personal Data that you shared with me to another provider or that I give it to you a copy in a machine-readable format so that you can transfer it to another provider.

Security precautions in place to protect the loss, misuse or alteration of your information

When you provide me with Personal Data, we take steps to ensure that it’s treated securely.

Non-sensitive details (such as, for example, your e-mail address, etc.) are transmitted normally over the Internet, and this can never be guaranteed to be 100% secure. As a result, while we strive to protect your Personal Data, we cannot guarantee the security of any information you transmit to us, and you do so at your own risk. Once we receive your information, we make our best effort to ensure its security on our systems.

Transferring your information outside of the European Economic Area

As part of our services, the information that you provide me with may be transferred to countries outside of the European Economic Area (EEA) (which includes all EU countries and non-EU countries Iceland, Liechtenstein and Norway). These countries may not have equivalent data protection laws to the EU or benefit from an adequacy decision by the EU Commission. By submitting your Personal Data, you’re agreeing to this transfer and processing. If I transfer your information outside of the EEA in this way, I will take necessary steps to ensure that appropriate security measures are taken with the aim of ensuring that your privacy rights continue to be protected as outlined in this Privacy Policy.

If you use my services while you are outside the EEA, your information may be transferred outside the EEA in order to provide you with those services.
